Paula’s Choice Duel Creator Agreement

Welcome to Paula’s Choice Insiders.

This is a collaboration between you, the creator, and Paula’s Choice Europe B.V. (including its licensed brands and subsidiaries such as but not limited to Paula’s Choice and Paula’s Choice UK, hereinafter referred to as “Paula’s Choice”). We can't wait to see you talking about our brand. As a Paula’s Choice Insider, you'll play a crucial role in championing our products/services and helping us reach new heights. Here's what we expect from you:

When posting on social media, you must include:

  • Tags to all relevant Paula’s Choice UK channels @paulaschoiceuk.
  • Brand hashtags #paulaschoiceinsiders and #pcglow.
  • Imagery that is respectful and appropriate for all audiences.
  • #ad disclosure. By becoming part of this community, you agree to comply with applicable laws, including guidance issued by the UK Advertising Standards Authority regarding the disclosure of paid advertising. Following ASA guidelines, please use #ad across all your content and/or follow any other guidelines as may be valid from time to time.   • Co-operate fully with Paula’s Choice.
  • Use reasonable care and skill in the provision of the services you are supplying on the Paula’s Choice Insiders.
  • Not retouch your skin or images in any materials supplied to Paula’s Choice or posted.
  • Ensure appropriate disclosures are used when posting on behalf of Paula’s Choice or as part of your participation in the Paula’s Choice Insiders.
  • Not do or say anything for whatever reason which is or may reasonably be considered by Paula’s Choice to be detrimental or prejudicial to Paula’s Choice, or which may reasonably be considered by Paula’s Choice to:
    1. Adversely affect their commercial reputation or business.
    2. Bring them into disrepute.
  • Not include any music in your materials unless use of this music is fully licensed.

Please always follow the reasonable instructions that Paula’s Choice may give you on the use of the products and the brand.

When posting on social media, you must not include:

  • References to products/services from any other brands.
  • Mentions, images, or references to any offensive, harmful, or illegal content.
  • Degenerative comments towards competitors, employees, social personalities, or religious characters.
  • Content that infringes on the intellectual property rights or privacy of any third party.

We will monitor the Paula’s Choice Insiders. If you do anything that is or could reasonably be construed as being unlawful or contrary to applicable law and/or these terms, we may remove you from the community immediately. Compliance with applicable laws and the above is your sole responsibility and you fully and effectively indemnify Paula’s Choice UK for any damages or losses it may suffer as a result of your noncompliance.

As a member of the Paula’s Choice Insiders, you agree that any content you submit to the program may be used and re-purposed by Paula’s Choice and any relevant or associated retailers for promotional, marketing, and advertising purposes, both online and offline, without any compensation beyond the benefits provided as part of Paula’s Choice Insiders. If and to the extent required, you hereby grant Paula’s Choice UK a royalty-free, unlimited, unrestricted, and perpetual right to use any content you submit to the program for the above mentioned purposes.

Commission and Promo codes:

  • If you are invited to participate, you will need to sign up and create an account with our third-party provider, Duel.
  • Upon successful completion of sign-up, you will be given a unique promotional code by Duel.
  • Commissions shall be payable by Duel once a month and upon signing up to Paula’s Choice Insiders, you will have access to a unique dashboard page with Duel to view your referrals and pending commission. Please consult their policies at Duel Terms of Use

Paula’s Choice reserves the right to modify the terms of the Paula’s Choice Insiders at any time without prior notice, and any substantive changes will be communicated to you via email and be effective immediately.

Discount Vouchers:

  • As part of the Paula’s Choice Insiders, you will be given vouchers to spend on our products (the ‘Discount’), which is for personal use only.
  • Complementary products or products purchased by you using the discount are for personal use only, and none of the foregoing may be resold or exchanged under any circumstances. Any returns will take into account the discount that was applied. If we become aware that you are reselling the products, we reserve the right to revoke the Discount, Promo Code, and Commission with immediate effect. We also respectfully point out the damaging effect this could have on our relationship going forward.
  • Paula’s Choice reserves the right to remove the offer at any time if we deem the voucher code is misused, or if we discontinue, limit, or change the terms of the Paula’s Choice Insiders.

Voucher Usage:

  • One-time use only.
  • The total value of the voucher must be used in one transaction.

Data:

One of the great benefits of becoming part of the Paula’s Choice Insiders is that you get to hear all about our new products, special offers, events, and skincare and self-care tips should you wish to. We need your consent to send you these promotional emails, which you would have already provided if you opted in to receiving marketing emails when you signed up for the Paula’s Choice Insiders. You can change your mind about receiving these emails by using the unsubscribe function at the bottom of each email. For information on how we will process your data, please read our Privacy Policy

How your data will be used:

Paula's Choice Europe B.V. will be the data controller of the personal data you provide to us when you apply to become part of the Paula’s Choice Insiders and, if you are accepted, of any personal data you provide to us whilst you are a member.

The Paula’s Choice Insiders is run by a trusted third party (Duel) on behalf of Paula's Choice Europe B.V., accordingly, any personal data provided to Duel will be governed by Duel’s privacy policy. If you would like to apply to join (and if your application is accepted, participate in) the Paula’s Choice Insiders, please review this Creator Agreement and also Duel’s privacy policy and (only if you agree to the processing of your personal data as set out in this Creator Agreement and also Duel’s privacy policy) sign below.

Termination:

You or Paula’s Choice UK can delete your Paula’s Choice Insiders account at any time. Your partnership may be terminated by Paula’s Choice UK if:

  1. You fail to post at least once on your IG Grid or TikTok feed within 30 days after receiving your Paula’s Choice product.
  2. Your account is inactive for a period of 3 months or longer.
  3. You fail to meet the program expectations, which may include but are not limited to:
    • Posting or submitting content that is of low quality.
    • Posting or submitting content that doesn’t adhere to our Paula’s Choice UK guidelines.
    • Posting or submitting content that doesn’t meet the terms outlined above.
